Terms and Conditions (T&Cs)

Seller: Åsa Söderman, trading as “Åsa Tricosa” (hereinafter the “Seller”).

1. Scope of Application

1.1 These Terms and Conditions (“T&Cs”) apply to all contracts concluded via the Seller’s online shop with consumers (the “Customer”).

1.2 Deviating terms of the Customer do not apply unless expressly agreed in writing.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Conclusion of Contract

2.1 Product descriptions in the online shop are not binding offers but serve to enable the Customer to submit a binding offer.

2.2 By completing the checkout process and clicking the order button, the Customer submits a legally binding offer regarding the items in the cart.

2.3 The Seller may accept the Customer’s offer within five days by (i) sending an order confirmation by email or (ii) delivering the goods. The contract is concluded when the first of these alternatives occurs. If no acceptance is made within five days, the Customer is no longer bound by their order.

2.4 For payments processed via PayPal or Shopify Payments (Stripe), the contract may be concluded upon confirmation of payment by the Customer, in accordance with the terms of the respective payment provider.

2.5 The contract text will be stored by the Seller and sent to the Customer in text form (email) after conclusion. If the Customer has created an account, order details can also be accessed there.

2.6 Before submitting the order, the Customer can identify and correct input errors using the standard browser and form functions.

2.7 The contract language is English.

2.8 Order processing and communication generally take place by email. The Customer must ensure that the provided email address is correct and that messages can be received.

3. Right of Withdrawal

3.1 Consumers have a statutory right of withdrawal. Details are provided in the separate Withdrawal Information.

3.2 For digital content (e.g., downloadable knitting patterns) not supplied on a tangible medium, the right of withdrawal may expire if the Customer has expressly agreed to the start of performance before the withdrawal period ends and acknowledged that they thereby lose their withdrawal right.

3.3 The right of withdrawal does not apply to Customers resident outside the European Union who provide a non-EU delivery address.

4. Prices and Payment

4.1 All prices include statutory VAT where applicable. Shipping costs are shown separately.

4.2 Additional charges such as customs duties, import taxes or bank fees may apply for deliveries outside the EU and are borne by the Customer.

4.3 Payment options are displayed in the online shop. Payment processing may be carried out by third-party providers such as PayPal or Shopify Payments (Stripe) under their terms.

5. Delivery and Digital Content

5.1 Goods are delivered to the delivery address provided by the Customer.

5.2 If delivery fails due to circumstances attributable to the Customer (e.g., incorrect address, uncollected parcel), the Customer must bear the resulting costs. This does not affect statutory withdrawal rights.

5.3 The Seller may withdraw from the contract if goods are not available despite a proper covering transaction. In such cases, the Customer will be informed without delay and any payments refunded.

5.4 Self-collection is not possible for logistical reasons.

5.5 Digital content is provided electronically, for example via download link, email, or customer account.

6. Usage Rights for Digital Content

6.1 The Customer receives a non-exclusive, non-transferable right to use the digital content for personal, non-commercial purposes.

6.2 Sharing, resale or commercial exploitation of the content is prohibited without express permission.

6.3 The Customer may store and print digital content for private use.

7. Retention of Title

Delivered goods remain the property of the Seller until paid in full.

8. Warranty (Liability for Defects)

Statutory consumer rights for defects apply in accordance with Danish law and EU consumer protection rules.

9. Liability

9.1 The Seller is liable for intent and gross negligence.

9.2 For cases of slight negligence, the Seller is only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable and typical damages.

9.3 The above does not affect liability for injury to life, body or health, or liability under mandatory product liability legislation.

10. Applicable Law

10.1 These T&Cs are governed by the laws of the Kingdom of Denmark.

10.2 Mandatory consumer protection rules of the country where the Customer has their habitual residence remain unaffected.

11. Alternative Dispute Resolution

The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board. In Denmark, consumers may contact the Danish Mediation Team for Consumer Complaints (“Center for Klageløsning”) and, if eligible, the Danish Consumer Complaints Board (“Forbrugerklagenævnet”).
